Free Music Downloads – How Legal Is It?

Sure there are people out there in this big old world of ours who don’t like music, but thankfully they are few and far between. Music is enjoyed by most people, some have the rhythm in them and some don’t but it doesn’t stop people from bopping along to the latest tunes. With computers becoming more and more a part of our lives and the internet a trusted friend, people want to be able to download free music for their listening pleasure.

What you need to be aware of is that there are laws that govern music download, and though they vary from country to country they do exist. Copyright laws are in force and you can get sued for illegal downloads. Much as you love your music surely you don’t want to be hit by a lawsuit. There is a fine line between legal downloads and illegal downloads. The problem seems to lie in the fact that while technology is advancing by leaps and bounds, the laws are struggling to keep up.
 
 

There are definitely grey areas in which it is difficult to ascertain whether the free music download are legal or not. In order to legally download music you need to get the permission of the copyright holder. This seems clear enough or does it? After the Sony Corporation versus Universal City Studios judgment was announced people can download music for pure entertainment and not for commercial use. Even copyrighted material can be downloaded. So Confusing – you bet!

 

The understanding in this ruling is that you can download for your listening pleasure or for a party you are planning and you are not going to get sued for violating copyright laws to download music. However, the record industry’s position is abundantly clear, uploads and downloads are both illegal and can result in you being sued.

For all practical intents and purposes the mere act of downloading music has not been cause enough to trigger RIAA attention. The reason for this is because it seldom detects the music downloads and how many people is it going to keep track of anyway? While RIAA can see that files are being downloaded and also see the IP addresses, the actual act of seeing what the files contain is virtually impossible.



In other countries the legal standing of music downloads is a lot more ambiguous and while countries like Canada tried to stop infringement by making uploads illegal to cover private copying to blank CDs, etc. they did not take into consideration the technological advancements that would one day bring iPods and MP3 players into the game.

Here’s another example of just how vague the whole music download business is. If you download to an iPod or your computer’s internal hard drive it could constitute infringement of copyright laws. If you download to an external hard drive that is not embedded in your system and whose only function is to serve as a memory cache would be legal in countries like Canada. Go figure!
